WV Law Updates

Judge of the Court of Claims
 The West Virginia State Bar is seeking candidates for the position of Judge of the Court of Claims. The State Bar Board of Governors will nominate three (3) lawyers and will submit these names to the Speaker of the House and the President of the Senate for appointment to the Court. The term is for six (6) years. A minimum of ten (1 0) years' experience as a licensed attorney is required. A full description of qualifications can be found in W.Va. Code Section 14-2-4 and 14-2-10, and compensation is provided for in W.Va. Code Section 14-2-8. This position involves hearing and deciding claims filed against state agencies and the Crime Victims Fund. The main offices of the Court are at the State Capitol and the position requires travel throughout the state to attend hearings. Some administrative law, mediation, or other judicial experience would be beneficial.

Pro Bono Assistance Needed

The West Virginia State Bar needs more volunteers to sign up to provide pro bono basic legal advice on West Virginia Online Legal Help (WVOLH).  WVOLH is a website where low-income West Virginians can post questions about their civil legal needs.  Volunteer attorneys answer those questions by providing basic information, legal advice and referrals for free. Please go to www.wvonlinelegalhelp.org and click on "Lawyers Sign Up" to sign up to volunteer.  We have almost 30 unanswered questions on the website and could use your help. 

Reprint of State Court Rules

In August a reprint of the 2016 Michie's West Virginia State Court Rules volume was issued.  Due to errors and omissions in the previously issued 2016 volume, as well as the supplement thereto, this reprint completely replaces the January softbound volume AND the May 2016 softbound supplement for the state court rules.

Remember that the print version is only as current as the last edition or supplement's publication date.  For the most current, up-to-date version of West Virginia Rules of Court, always rely upon
those on the Court's website at 



Corrections to Rules of Professional Conduct and Lawyer Disciplinary Procedure
  The West Virginia State Bar and the Office of Disciplinary Council want to notify attorneys that certain sections of Michie's West Virginia Code Annotated, State Court Rules 2016 are incorrect. Correct links to the incorrect sections are as follows:

Laurie Barbe Receives
President's Award

Laurie Barbe, Steptoe & Johnson PLLC, Morgantown, has received the President's Award during the DTCWV 34th Annual Meeting in Myrtle Beach, WV
Immediate Past Past President Jeffrey Holmstrand presented the award to Laurie durng the Tuesday banquet.  This award may be given at the sole discretion of the President for someone who has served DTCWV and the organized defense bar.

Receives DTCWV
  Defense Attorney of the Year Award      


Lee Murray Hall, Jenkins Fenstermaker, PLLC, Huntington received this prestigious award during the DTCWV 34th Annual Meeting  held this week in Myrtle Beach, SC.  The announcement was truly a total surprise to the well deserving Huntington attorney.  Lee is a past president of DTCWV and is involved in numerous local, state and national organizations.

The Nominating Committee received nominations from membership for the award.
